It is compulsory to register the sale deed under the provisions of the Registration Act, 1908. This is the process which is essential as well as exciting for the home buyer. While you might have already read a great deal about the process of register your property in India and must know quite well about it, as a law firm we give you some helpful tips that would assist you to complete the process with no hassle.

Let us glance at that in eight steps.

Preparations: Day before, sit and keep all the papers that are required at the time of registry or register your property. Do not fiddle with all documents over and over. You run the risk of losing the documents in case you are not cautious. Before you leave your Office or workplace, make sure you gathered all your required documents.

Timings: The office of the Sub-Registration Magistrate works between 9.30 am and 6 pm on all working day. Moreover, between 2 and 2:30 pm is the lunchtime. Therefore, plan your entire day accordingly.

It would be better if you do not plan anything else for the day on which the register of the property is to take place. As your whole day will be spent here. Hence, it is vital to you that all goes fine, keep your focus just on one thing.

Payment: Since all things are done these days digitally, stamp duty and registration charges are paid much before you appear in the sub-registrar’s office to register your property in India. Take legal advice from property lawyers to take care of this part of the transaction, too. It is only after paying stamp duty and registration charges that an appointment is made at for property registration.

Documents: In addition to the property document, keep close to you at all times your Aadhaar and PAN Card. In place of Aadhaar, you could also present your voter ID card or passport or driving license. These are the first things you will have to show when the Teller, the Reader, and the Sub-Magistrate call your name.

TDS: In case the agreement size was of over Rs 50 lakh, the property buyer will have to submit a proof revealing he has deducted one percent as TDS from the property value or land value. Do not forget to keep that document with you.

Witness: Your witnesses are quite essential for the process to take place. They have to be near with you through the entire process and must have a valid ID proof along with them. Your witnesses should ideally be a person you know well. Under no conditions consider their role in the process as only academic.

No privileges: All are treated fairly in the Sub-Registrar’s Office. There are, for example, no separate queues for women or senior citizens.

Delivery: Typically, it takes 15 days for your documents to get registered. Your documents will be returned back to you only after you produce the receipt that was subjected to you at the time of registration of property in India. In a matter, if you have taken a home loan, the bank might send its representative to collect the document. You could also receive the papers and give it to the bank yourself.
